Terms of Service
The agreement between you and Writeout when you use our apps and website.
Last updated October 27, 2026
These Terms of Service ("Terms") are an agreement between you and Writeout LLC ("Writeout", "we", "us"). They cover the Writeout website at writeout.co, our iOS and Android apps, and everything you can do there (together, the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, our Community Rules and, if you buy Writeout+, our Subscription Terms. If you don't agree, please don't use Writeout.
1. Who can use Writeout
You must be at least 13 years old to create an account. We ask for your date of birth when you sign up, and we won't create an account for anyone under 13. If you are under 18, or under the age of majority where you live, you may only use Writeout with the permission of a parent or guardian, who agrees to these Terms for you.
You can't use Writeout if we have banned you before, or if you are barred from receiving services under the laws of the United States or the country where you live.
2. Your account
Give us accurate information when you sign up and keep it current. You can sign in with an email and password, or with Google or Apple. Keep your sign-in details private: you are responsible for what happens on your account. Tell us right away at help@writeout.co if you think someone else has access to it.
One person, one account. Don't share, sell, or transfer your account, and don't create accounts to get around a ban or to collect extra rewards.
Your username and display name can't impersonate someone else, use someone else's trademark, or be offensive. We may change or reclaim a username that breaks these rules.
3. What Writeout is
Writeout is a place to write and read stories. You can publish stories, chapters, series, text stories and chat stories, write with others in group stories and live co-writing, post updates with photos and polls, comment, react, follow writers, message people, answer the Daily Prompt, and enter Head to Head. We are in beta and change the Service often. We may add, change, limit, or remove features at any time, with or without notice.
4. Your content
You own what you write. Stories, posts, comments, prompt entries, messages, images and anything else you put on Writeout (your "Content") stay yours.
To run Writeout we need permission to use your Content. When you post Content, you give us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to host, store, copy, use, display, publish, adapt, format, translate, distribute, and promote it, in any media, on and off the Service. This includes showing it in our own promotion of Writeout (for example, featuring a story on Discover, in our blog, or on our social accounts), and letting other people read, share links to, and interact with it as the Service allows.
Writeout makes money from the Service, including from ads, sponsored posts, Writeout+, coin sales, and other monetization that may appear on, next to, or around your Content or on screens related to it. That revenue belongs to Writeout. You are not entitled to any payment, royalty, or share of revenue for any use of your Content, including when it appears next to ads or helps us earn money. Tips are not an exception: coins other members send you are virtual items, usable only inside Writeout as described in section 7, and are never paid out or redeemable for cash.
If you delete Content or your account, we will stop showing it on the Service within 30 days, except for copies in backups that we remove over time, Content that others are part of (such as a group story you contributed to), and anything we must keep for legal or safety reasons. Deleting Content doesn't undo uses we already made of it, such as promotions already published.
You promise that you have the rights to everything you post, and that posting it doesn't break the law or anyone else's rights (including copyright, privacy, and publicity rights). Don't post someone else's writing as your own.
Keep your own copies of anything important. We back up our systems, but we can't promise that Content will never be lost.
5. Community Rules and moderation
Everything you do on Writeout must follow our Community Rules (writeout.co/legal/community-rules). In short: be kind, keep it safe, keep it yours, and keep contests fair.
We may review, hide, label, or remove Content, and we may warn you, limit features (such as messaging or posting), suspend, or permanently ban your account if we believe you have broken these Terms or the Community Rules, or to protect people or Writeout. We use a mix of reports from members, automated checks (for example, on uploaded images), and human review. We don't review everything, and we aren't responsible for what other members post.
We decide, in our sole discretion, whether Content or conduct breaks these Terms or the Community Rules and what action to take, and we have the final say. That includes whether to suspend an account, for how long, and whether a suspension forfeits some or all of its coins, tips, Writeout+ time, or other virtual items. If you think we got a decision wrong, email help@writeout.co and we will take another look, but the outcome of that review is final.
6. Daily Prompt and Head to Head
The Daily Prompt and Head to Head are free contests of writing skill, decided by votes and our rules, not by chance. No purchase is needed to enter or to win. Each contest's rules (such as entry limits, voting, rounds and prizes) are shown in the app and may change from contest to contest.
Prizes are coins, badges, and recognition on Writeout. They have no cash value. We may hold, cancel, or take back results and prizes if we see cheating, vote manipulation, extra accounts, or entries that aren't the entrant's own work. Our decisions on contest results are final. Contests are void where prohibited by law.
7. Coins and other virtual items
Writeout has coins and other virtual items such as badges and streaks. You can earn coins (for example, by entering contests, keeping streaks, or watching an optional rewarded ad), receive them as a tip from another member, or buy them.
Coins and virtual items are a limited license to use inside Writeout. They aren't money, have no cash value, can't be exchanged for cash or anything outside Writeout, and can't be sold or transferred except through features we provide (such as tipping a writer). Tips are final, and coins received as tips can't be cashed out, withdrawn, or redeemed for money or anything else of value, by you or by us on your behalf.
We may change how coins and virtual items work, including what they cost or what they unlock. If your account is banned, you forfeit all coins, tips, Writeout+ time, and other virtual items on it, including ones you paid for, with no refund or compensation, except where the law requires otherwise. The same applies if you delete your account. Except where the law requires otherwise, purchases of coins are final and non-refundable.
Spent coins are never refunded. Once you use coins (for example, to tip a writer, unlock an item, or anything else in Writeout), the coins and the purchase they came from can't be refunded, returned, or exchanged, even if you later change your mind, the item or feature changes or is removed, your Content is taken down, or your account is suspended, banned, or deleted. If a purchase of coins is refunded or charged back after you spent them, we may remove coins from your balance, make it negative, or limit your account until it is settled.
8. Purchases and Writeout+
Writeout is free to use. You can buy coin packs and the optional Writeout+ membership. Prices are shown before you pay, in your local currency where available, and may include taxes.
In our iOS and Android apps, purchases are made through the Apple App Store or Google Play and are also governed by that store's terms. On the web, payments are processed by Stripe. We never see or store your full card number.
Writeout+ renews automatically until you cancel. Our Subscription Terms (writeout.co/legal/subscription) explain billing, renewal, cancelling, and refunds, and are part of these Terms.
9. Ads
Writeout shows ads, including ads in the feed and optional rewarded ads that give you coins. Writeout+ members don't see ads in their feed. We may also show sponsored posts, which are labeled. We aren't responsible for the products or websites that advertisers offer.
10. Linked accounts and other services
You can link other services to Writeout, such as Spell (our word games app), Google, Apple, or Discord. When you link them, their own terms and privacy policies also apply. Writeout may link to websites we don't run, and we aren't responsible for them.
11. Things you must not do
Along with the Community Rules, you agree not to:
•
Break the law, or help anyone else break it.
•
Use bots, scripts, scrapers, or other automation to access Writeout, create accounts, post, vote, or collect data, unless we have agreed in writing.
•
Copy or harvest other members' Content or personal information.
•
Interfere with or try to get around how Writeout works, including security features, rate limits, bans, or age checks.
•
Probe, scan, or test our systems for weaknesses without our permission, or upload viruses or harmful code.
•
Use Writeout's Content to train artificial intelligence models without our written permission.
•
Reverse engineer our apps, except where the law allows it.
12. Our content and brand
Apart from Content posted by members, Writeout (including our apps, website, design, art, logos, and the Writeout name) belongs to us and our licensors and is protected by law. You may not use our name or logos without our written permission. If you send us ideas or feedback, we can use them freely without paying you.
13. Copyright complaints
We respect copyright and respond to notices under the U.S. Digital Millennium Copyright Act (DMCA). If you believe something on Writeout infringes your copyright, email our copyright agent at copyright@writeout.co or write to Writeout LLC, Attn: Copyright Agent, PO Box 338, West Henrietta, NY 14586, United States. Your notice must include:
•
Your physical or electronic signature.
•
A description of the work you believe was copied.
•
The link or other location of the material on Writeout.
•
Your name, address, phone number, and email.
•
A statement that you believe in good faith that the use isn't authorized by the owner, its agent, or the law.
•
A statement, under penalty of perjury, that your notice is accurate and that you are the owner or are allowed to act for the owner.
copyright@writeout.co
14. Counter notices and repeat infringers
If we remove your Content after a copyright notice and you believe it was a mistake, you can send a counter notice to the same address with the details required by 17 U.S.C. 512(g). We close the accounts of people who repeatedly infringe copyright.
15. Ending your account
You can delete your account at any time in Settings, under Account. Deleting it removes your profile and the Content we can link to you, as described in our Privacy Policy. Coins, Writeout+ time already paid for, and other items are lost. If you subscribed through the App Store or Google Play, cancel there too, because deleting your account doesn't stop the store's billing.
We may suspend or end your access at any time, at our discretion, including if you break these Terms, if we must for legal reasons, or if we stop offering the Service. Sections of these Terms that by their nature should continue (such as the Content license in section 4, coin and forfeiture rules, disclaimers, limits on liability, indemnity, and disputes) continue after your account ends.
16. Disclaimers and app failures
Writeout is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including that the Service will be uninterrupted, secure, error free, or fit for a particular purpose, or that Content on it is accurate. Member Content reflects the views of its authors, not ours. Some places don't allow these disclaimers, so some may not apply to you.
Apps and websites fail sometimes. Writeout may be slow, unavailable, or not work as expected because of bugs, outages, maintenance, updates, or problems with our providers, your device, or your connection. We are not liable for any loss caused by an app failure, including lost or corrupted Content, drafts, messages, coins, tips, streaks, contest entries, votes, results, or Writeout+ time. We may, at our discretion, restore or make up for something lost to a failure, but we don't have to.
17. Limits on our liability
To the fullest extent the law allows, Writeout and its owners, staff, and partners won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Service or from any Content or conduct on it.
To the fullest extent the law allows, our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or 100 U.S. dollars. Some places don't allow these limits, so they may not apply to you.
18. Indemnity
If someone makes a claim against us because of your Content or because you broke these Terms or the law, you agree to cover our reasonable costs, including legal fees, to the extent the law allows.
19. Disputes and arbitration
These Terms are governed by the Federal Arbitration Act and, otherwise, by the laws of the State of New York, without regard to conflict of law rules. If you have a problem with Writeout, please email help@writeout.co first and give us 30 days to try to resolve it. Most issues can be fixed quickly.
Arbitration: if we can't resolve a dispute informally, you and we agree that it will be settled by binding arbitration on an individual basis, not in court. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules (or its Comprehensive Arbitration Rules for claims over $250,000) and the JAMS Consumer Minimum Standards, before a single neutral arbitrator who is a lawyer or retired judge. If 25 or more similar claims are filed against us by or with the help of the same lawyers or organizations, the JAMS Mass Arbitration Procedures also apply. All hearings will be held online, by video or phone. Neither of us has to travel. You can find the JAMS rules at jamsadr.com. The arbitrator decides only your and our individual claims and can award the same individual relief a court could.
Arbitration costs: if you start an arbitration, you pay the JAMS filing fee up to the amount the JAMS Consumer Minimum Standards allow, and the remaining JAMS fees are paid as those standards require. Each side pays its own lawyers, experts, and other costs. Writeout will not pay your legal fees unless the arbitrator awards them under a law that would let a court award them. If the arbitrator finds a claim was brought in bad faith or for an improper purpose, the arbitrator may make the person who brought it pay the other side's fees and costs.
Exceptions: either of us may bring an individual claim in small claims court, and either of us may go to court to stop infringement or misuse of intellectual property. Any court case allowed by these Terms will be brought only in the state or federal courts located in Monroe County, New York. You and we each give up the right to a jury trial.
Opting out: you can opt out of arbitration within 30 days of first accepting these Terms by emailing help@writeout.co from the email address on your account, with your name, username, and a clear statement that you opt out of arbitration. Opting out doesn't affect any other part of these Terms. If you opt out, disputes go to the Monroe County courts described above.
If you live in the European Union, the United Kingdom, or another place whose consumer laws give you the right to go to your local courts or that protect you regardless of these Terms, you keep those rights.
Class action waiver: to the fullest extent the law allows, you and we each agree to bring claims only on our own behalf, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. No arbitrator or court may combine more than one person's claims or preside over any class or representative proceeding unless we both agree in writing. If this waiver is found unenforceable for a particular claim, that claim must be separated and heard in the Monroe County courts on its own, after any arbitration of the other claims, and the rest of this section still applies.
20. Apple and Google
If you use our iOS app, these Terms are between you and Writeout only, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims about the app (including product liability, legal compliance, or intellectual property claims). If the app fails to meet any warranty that applies, you may notify Apple and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the iOS app must also follow the Apple Media Services Terms.
If you use our Android app, Google Play's terms also apply, and Google isn't responsible for the app.
21. Changes to these Terms
We may update these Terms as Writeout changes. When we make a significant change, we will tell you in the app or by email before it takes effect, and may ask you to accept the new Terms. If you keep using Writeout after a change takes effect, you accept the updated Terms. If you don't agree, you can delete your account. Changes to section 19 (Disputes and arbitration) won't apply to any dispute that you or we already knew about before the change took effect.
22. Everything else
These Terms, together with the policies they mention, are the whole agreement between you and us about the Service. If any part of these Terms is found illegal, invalid, or unenforceable, that part is limited or removed only as much as needed, and the rest of these Terms stays in full effect. If we don't enforce a part right away, we haven't given up the right to enforce it later. You can't transfer these Terms to anyone else; we may transfer them as part of a merger, sale, or reorganization. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers, natural disasters, or government action. You agree that we can send you notices and other communications electronically, by email or in the app, and that these satisfy any requirement that they be in writing. Apart from Apple as described above, no one else has rights under these Terms. If these Terms are translated, the English version controls.
